1. Eligibility

• 1.1. You must be at least 18 years of age to use the App.
• 1.2. By creating an account, you affirm that you comply with all applicable laws, including the Indian Contract Act, 1872, and the Information Technology (IT) Act, 2000.
• 1.3. We may require you to submit government-issued identification (e.g., PAN, Aadhaar) for KYC verification to confirm your age and identity, per IT Act Section 69A and DPDP Act, 2023 requirements. Failure to comply may result in account suspension.
• 1.4. Use by individuals under 18 or uploading content involving minors is prohibited, per POCSO Act Section 11. Violations will be reported to authorities under Section 19.

2. Account Responsibilities

• 2.1. Users must provide accurate information during registration.
• 2.2. You are responsible for maintaining the confidentiality of your account credentials.
• 2.3. Any activity under your account is deemed to be authorized by you.
• 2.4. You consent to identity verification processes, including selfie-based liveness checks, to ensure compliance with these Terms.

3. Prohibited Activities

• 3.1. Users shall not:
  • Use the App for any illegal activities, including those outlined under the Indian Penal Code (IPC), 1860.
  • Post or transmit harmful, defamatory, obscene, or abusive content.
  • Engage in harassment or unsolicited communication with other users.
  • Engage in activities involving minors, per POCSO Act Section 14 (use of children in content).
• 3.2. We reserve the right to terminate accounts that violate these terms or applicable laws.

4. User Conduct and Safety

• 4.1. The App serves as a platform to connect individuals; the Company does not guarantee any outcome or compatibility.
• 4.2. We recommend users exercise caution while interacting with others and report any suspicious behavior via support@areksoft.com.
• 4.3. Users agree not to hold the Company liable for any interactions, including but not limited to offline meetings or disputes.
• 4.4. By uploading photos, you grant Areksoft Technologies Private Limited a non-exclusive, royalty-free license to display them on Crush and Hug, revocable by deletion. You confirm all individuals in photos have consented, per IPC Section 441 (criminal trespass) and IT Act Section 66E (privacy violation).
• 4.5. Photos must not violate IPC Sections 292-294 (obscenity) or IT Act Section 67A (sexually explicit content). We may remove non-compliant content without notice.
• 4.6. We are not liable for third-party misuse of your content (e.g., screenshots or external sharing), per IT Act Section 79 safe harbor provisions.

5. Privacy Policy

• 5.1. All user data is processed in compliance with the IT (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011.
• 5.2. By using the App, you consent to the collection, storage, and processing of your personal data as detailed in our Privacy Policy.
• 5.3. We retain your data only as long as necessary for app functionality or legal compliance, per DPDP Act. You may request deletion via support@areksoft.com, subject to verification.

6. Intellectual Property

• 6.1. The App’s design, trademarks, and content are the intellectual property of Areksoft Technologies Private Limited.
• 6.2. Users may not reproduce, distribute, or modify the App’s content without prior permission.

7. Limitation of Liability

• 7.1. The Company shall not be held liable for any direct, indirect, incidental, or consequential damages arising from the use of the App.
• 7.2. Users agree that the App is provided on an “AS IS” and “AS AVAILABLE” basis.
• 7.3. You agree to indemnify and hold Areksoft Technologies Private Limited harmless from any claims, damages, or legal fees arising from your use of Crush and Hug, including violations of these Terms or applicable laws.
• 7.4. Areksoft Technologies Private Limited is not liable for service interruptions due to force majeure events, including acts of God, government actions, or cyberattacks beyond our control.

8. Third-Party Links and Services

• 8.1. The App may contain links to third-party websites or services, which are not controlled by the Company.
• 8.2. Users access such third-party resources at their own risk.

9. Governing Law and Jurisdiction

• 9.1. These Terms shall be governed by and construed in accordance with the laws of India and the state of Telangana.
• 9.2. Disputes shall first be resolved through arbitration in Hyderabad, Telangana, per Arbitration and Conciliation Act, 1996, with exclusive jurisdiction of Hyderabad courts for unresolved matters.
• 9.3. If any provision of these Terms is deemed invalid, the remaining provisions shall remain in full force and effect.

10. Amendments

• 10.1. The Company reserves the right to update these Terms at any time. Continued use of the App after updates constitutes acceptance of the revised Terms.
• 10.2. Users will be notified of significant changes through the App or via email.

11. Termination

• 11.1. The Company may terminate or suspend your access to the App at its sole discretion for any violation of these Terms.
• 11.2. Upon termination, all rights granted under these Terms will cease immediately.
